Mobile Terms of Service

The André Noir mobile message service (the "Service") is operated by André Noir Ltd ("André Noir", "we", "our", or "us"). Your use of the Service constitutes your agreement to these Mobile Terms ("Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Terms at any time, and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of them.
1. Types of Messages
By consenting to André Noir’s SMS/text messaging service, you agree to receive SMS/text messages from and on behalf of André Noir through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list.
Text messages may be sent using an automatic telephone dialling system or other technology.
You may receive two types of text messages from us:

Service-related messages – such as order updates, delivery notifications, appointment reminders, and account alerts. These are sent as part of fulfilling your purchase or account activity and do not require marketing consent.

Promotional messages – such as offers, new collection announcements, event invitations, and cart reminders. These will only be sent where you have given explicit consent to receive marketing communications.
You understand that you do not have to sign up to receive promotional messages in order to make a purchase, and your consent is not a condition of sale. Your participation in the promotional message program is completely voluntary.
2. Charges and Frequency
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply. Message frequency varies depending on your interaction with us.
Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
3. Opt-Out and Support
You may opt out of the Service at any time.
Text the single keyword command STOP to AndreNoir or click the unsubscribe link (where available) in any text message to cancel.
You’ll receive a one-time opt-out confirmation message. No further promotional messages will be sent to your mobile device unless initiated by you.
If you have subscribed to other André Noir mobile message programs and wish to cancel those as well, you will need to opt out separately by following the instructions in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including STOP or HELP requests, sent to a short code or telephone number we have changed may not be received, and we will not be responsible for honouring requests made in such messages.
4. Data Use and Privacy
André Noir Ltd is the data controller for your personal information.
We process your personal data on the following legal bases:

Performance of a contract – to send service-related communications necessary to fulfil your order or account requests.

Consent – to send promotional or marketing communications, which you may withdraw at any time.
Your personal data will be processed in accordance with our Privacy Notice, which explains how we collect, use, store, and protect your information, as well as your rights under data protection law.
You can withdraw consent to promotional messages at any time by following the opt-out instructions above.
5. Liability and Disclaimer
To the extent permitted by applicable law, we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, or any action you may or may not take in reliance on the information or Service.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages.
You agree to provide us with a valid mobile number. If you change your mobile number, you must sign up for the program again using your new number.
6. Privacy Commitment
We respect your right to privacy. Your information will only be used in accordance with our Privacy Notice and relevant UK data protection laws (UK GDPR and PECR).
We will never sell your data or share it with third parties for marketing purposes without your explicit consent.
